Halloween Facebook Giveaway Terms & Conditions

  1. The promoter is: Have A Blast Toys + Games .
  2. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook.
  3. Your entry into the contest  does hereby release, acquit and forever discharge Facebook, its officers, directors, successors, shareholders, agents, assigns, employees, representatives, and any and all other persons, firms and corporations whatsoever, from any and all claims, demands, damages, actions, causes of action, or suits of any kind or nature whatsoever, both known and unknown, arising out of, related to or in any way connected with the contest.
  4. Employees of Have A Blast Toys + Games or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition.
  5. All Facebook comments that fulfill the contest criteria stated in the Facebook post and in these terms and conditions from 31 October 2017 12:00 am ET to 31 October 2017 11:59 pm ET will be entered into a drawing to win one (1) of six (6) Dorbz #234 Blackest Night Batman figures. Individual contestants (determined by Facebook username) may only enter the drawing once. More than one (1) entry per person will disqualify the entrant from any drawing.
  6. Individual entries are eligible to win one (1) prize. Prize winners are ineligible to enter all drawings after their winning entry is selected out of a drawing.
  7. 25 individual, verified entries must be received over the designated time period for each drawing to occur. If the promoter does not receive, at minimum, 25 individual, verified entries the contest will be null and void.
  8. After 150 qualifying comments or at 31 October 2017 11:59 pm ET no further entries to the competition will be accepted as valid. The promoter will pay for shipping and applicable taxes for contest winners within the 48 continental United States (US). Contest winners from Alaska, Hawaii, all US territories, and non-US countries must pay for shipping and any applicable taxes and/or import charges. If any contest winner declines the contest prize, the promoter will hold a second drawing to determine another winner. If the promoter cannot determine a contest winner after two drawings, the contest will be null and void. 
  9. No responsibility can be accepted for entries not received for whatever reason.
  10. The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter.
  11. No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
  12. The winner will be chosen at random by a drawing conducted by a representative of Have A Blast Toys + Games from all entries received and verified by Promoter and or its agents.
  13. The winner/s will be notified by a Facebook comment or message within 28 days of the closing date. The winner/s will also be announced by blog post on haveablasttoys.com. If the winner cannot be contacted or do not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
  14. The promoter will notify the winner when and where the prize can be collected.
  15. The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
  16. By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
  17. The competition and these terms and conditions will be governed by US law and any disputes will be subject to the exclusive jurisdiction of the courts of US.
  18. The winner agrees to the use of his/her name and image in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with current US data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
  19. Entry into the competition will be deemed as acceptance of these terms and conditions.
